CHAPTER 7 BANKRUPTCY
New Laws and the Means Test:
In my experience at least 90% of you who could have filed a Chapter 7 or
Straight Bankruptcy before the laws changed still can with almost the
same results as before. The Means Test is a test of your ability to pay
your consumer debts. It's goal was to move higher income earners into
Chapter 13 Bankruptcies. Chapter 13 or Consolidation Bankruptcy is a
Bankruptcy with a monthly payment plan that requires you to pay back all
or a portion of the balances that you owe.

In a Chapter 7 your goal is to obtain a court order prohibiting collection of as many of your debts as possible. That order is called a Discharge Order. A Discharge Order is a permanent injunction prohibiting collection of a debt.
Not all debts can be discharged in bankruptcy for instance, spousal, child and family support cannot be discharged in bankruptcy. Bring your pay stubs for the last six months, tax returns for the most recent year, one statement for each account that you owe money to including all credit cards, collection accounts, car loans, home loans and so on. And if you owe taxes, bring the whole shoe box. We'll see if you qualify for Chapter 7 under the Means Test and discuss your specific debts and see which can be discharged.
